Design Patent Drawings
Drawings play a vital role in the design patent application. Every design patent application must include a drawing that gives a visual disclosure of the claim. It is very important that the drawing must be clear and complete. Also, the drawings must comply with the disclosure requirements of patent law.
Drawing Views
Drawings must include a sufficient number of views to completely disclose the appearance of the claimed design and also should be in black color on white background including the drawing figure number. Generally, a design patent consists of a set of 7 drawing views consistent with each other such as :
Perspective view
Front view
Back view
Left view
Right view
Top view
Bottom view
Surface Shading
The drawing should be provided with the right surface shading which shows clearly the character and contour of all surfaces of any three-dimensional aspects of the design. It is also necessary to distinguish between any open and solid areas using surface shading. Lack of appropriate surface shading in the drawing as filed may render the shape and contour of the design non-enabling under 35 U.S.C. 112.
Consistency
Consistency plays a major key-role in getting the design patent granted. All the drawing views must be consistent with one another. If the drawings are not consistent the examiner can send an office action in the drawings.
